Last updated: 21 October 2026

1. Scope

1.1 This Intellectual Property Policy forms part of the Terms of Use and the Terms of Sale. It governs the use of the Platform and the Content, and sets out the procedure for reporting infringement of Intellectual Property Rights on the Platform.

1.2 Capitalised terms used in this Intellectual Property Policy and not defined in it have the meanings given to them in the Terms of Use.

1.3 This Intellectual Property Policy is published in English and in Arabic. For consumers in the UAE, the Arabic version prevails if the two versions differ.

2. Ownership of content and trade marks

2.1 The Platform and all Content are owned by us or licensed to us by third parties. The Content is protected by copyright, trade mark, database and other Intellectual Property Rights laws of the UAE and of other countries, and by international treaties.

2.2 The Content includes the selection, arrangement, compilation and presentation of all material on the Platform, including Product listings, Product descriptions, photographs, page layouts and the design of the website and the mobile app. These are protected as a whole as well as individually.

2.3 The names and logos of One Basket and NEXTAURA 360, and the other names, logos, slogans and marks we use on the Platform, are our trade marks, whether registered or unregistered. They may not be used in connection with any product or service that is not ours, or in any manner that is likely to cause confusion or that disparages or discredits us.

2.4 The software, source code and object code of the Platform and of the mobile app, including any software licensed to us by third parties, are protected by Intellectual Property Rights. Third-party software components included in the mobile app are licensed under their own terms, which govern those components.

2.5 User Content remains the property of the person who submits it, subject to the licence granted to us under the Terms of Use.

2.6 All rights not expressly granted in the Policies are reserved by us and our licensors.

3. Permitted use

3.1 Subject to your compliance with the Policies, you may:

  1. access and view the Content on the Platform for the purpose of browsing Products, placing Orders and managing your Account;

  2. download and install the mobile app on a device you own or control, in accordance with the Terms of Use;

  3. download, save or print copies of pages relating to your own Orders, Account, invoices and the Policies, for your personal records;

  4. share a link to a Product page or other page of the Platform with another person for personal and non-commercial purposes, provided that the link does not suggest any association with, or endorsement by, us that does not exist; and

  5. submit User Content, where that feature is offered, in accordance with the Terms of Use.

3.2 The permitted uses in clause 3.1 are personal, non-exclusive and non-transferable, and they end if your access to the Platform is suspended or ended under the Terms of Use.

3.3 Any use of the Content that is not expressly permitted by clause 3.1 requires our prior written consent. Requests for consent may be sent to info@onebasket.ae.

4. Restrictions

4.1 Except as expressly permitted by clause 3.1 or by applicable law, you must not:

  1. copy, reproduce, republish, upload, post, transmit, distribute, sell, license or otherwise make available any Content;

  2. modify, adapt, translate or create derivative works from any Content;

  3. use any Content, including Product photographs and Product descriptions, on any other website, application, social media account, online store or printed material;

  4. use any of our trade marks, or any name, logo or mark confusingly similar to them, including in a domain name, social media account name, business name, keyword, metatag or advertisement;

  5. remove, obscure or alter any copyright notice, trade mark or other proprietary notice on the Platform or in any Content;

  6. extract or re-use all or a substantial part of the Content, or repeatedly and systematically extract or re-use insubstantial parts of it, including by scraping, crawling, automated agents or any other automated means;

  7. frame or mirror any part of the Platform, or use deep links in a manner that presents the Content as part of another service;

  8. copy, modify, decompile, disassemble or reverse engineer the Platform or the mobile app, or attempt to discover its source code, except to the extent that applicable law expressly permits this; or

  9. use any Content to build, train or supplement any database, directory, dataset, competing service or automated system.

4.2 Any use of the Content in breach of this clause 4 infringes our Intellectual Property Rights or those of our licensors, and is a breach of the Terms of Use.

5. Third-party brands shown on Product pages

5.1 Product pages may show the brand names, logos, trade marks, packaging and product images of the manufacturers or brand owners of the Products we sell. Those brand names, logos and trade marks belong to their respective owners.

5.2 We show third-party brand names and marks only to identify and describe the Products we offer for sale. Their appearance on the Platform does not mean that the brand owner sponsors, endorses or is affiliated with us or with the Platform, unless the Platform expressly states otherwise.

5.3 We are not the manufacturer of the Products we sell, unless a Product page expressly states otherwise. Product specifications, instructions and warranty terms supplied by manufacturers remain the responsibility of the manufacturer, without affecting our obligations to you as seller under the Terms of Sale and the other Policies.

5.4 Nothing in the Policies grants you any right to use any third-party brand name, logo or trade mark shown on the Platform.

6. Reporting infringement

6.1 We respect the Intellectual Property Rights of others. If you own an Intellectual Property Right, or are authorised to act on behalf of its owner, and you believe that any Content, any User Content or any Product offered on the Platform infringes that right, you may send us a notice under this clause 6 (an “Infringement Notice”).

6.2 An Infringement Notice must be sent by email to info@onebasket.ae with the subject line “Intellectual Property Notice”, or by delivery to our registered address set out in clause 10.

6.3 An Infringement Notice must contain:

  1. the full name, postal address, email address and telephone number of the person sending the notice;

  2. a statement of whether the sender is the owner of the Intellectual Property Right or is authorised to act on the owner’s behalf, and, where the sender acts for the owner, evidence of that authority;

  3. identification of the Intellectual Property Right said to be infringed, including, for a registered right, the registration number, the registering authority and the territory of registration, and, for an unregistered right, a description of the work or mark and evidence of ownership;

  4. identification of the material said to infringe, with enough detail for us to locate it, including the web address of each page concerned or the name of each Product concerned;

  5. an explanation of why the material is said to infringe the Intellectual Property Right, including, where relevant for a Product, the grounds for any claim that the Product is counterfeit;

  6. a statement that the sender believes in good faith that the use of the material complained of is not authorised by the owner of the Intellectual Property Right, its agent or the law;

  7. a statement that the information in the notice is accurate and complete; and

  8. the signature of the sender, which may be an electronic signature.

6.4 We may ask the sender for further information or evidence reasonably required to assess an Infringement Notice. An Infringement Notice that does not contain the information listed in clause 6.3 may not be acted on until the missing information is provided.

6.5 An Infringement Notice must be made in good faith. A person who sends a notice that is false, misleading or made in bad faith may be liable for the resulting loss under applicable law, and we may decline to act on further notices from that person.

7. Our response to an Infringement Notice

7.1 On receiving an Infringement Notice that contains the information listed in clause 6.3, we acknowledge it and review it within a reasonable time.

7.2 Following our review, we may take one or more of the following actions, as we consider appropriate:

  1. remove, or disable access to, the material complained of;

  2. withdraw the Product concerned from sale, or suspend its sale while we investigate with the relevant Supplier;

  3. where the material is User Content, notify the person who submitted it, giving the substance of the notice;

  4. request further information or evidence from the sender or from any other person concerned; or

  5. decline to take action, where the notice is incomplete, the claim is not adequately supported, or the use complained of appears to be lawful.

7.3 We inform the sender of the action we have taken.

7.4 We are not a court or tribunal and do not decide disputes about the ownership or infringement of Intellectual Property Rights. Any action we take under this clause 7 is without prejudice to the rights of the sender, of the person who submitted the material, and of us, to bring proceedings before a competent court or authority.

7.5 The withdrawal of a Product under this clause 7 does not affect the rights of a customer who has bought that Product. Those rights continue under the Terms of Sale, the Returns and Refund Policy, the Warranty Policy and applicable law.

7.6 We may share an Infringement Notice, including the sender’s name and contact details, with the person who submitted the material complained of and with any Supplier concerned, so that they may respond. Personal data in an Infringement Notice is handled in accordance with the Privacy Policy.

8. Counter-notice

8.1 If User Content that you submitted is removed or disabled under clause 7, and you believe that it was removed in error or that you have the right to use the material, you may send us a counter-notice (a “Counter-Notice”) by email to info@onebasket.ae with the subject line “Intellectual Property Counter-Notice”.

8.2 A Counter-Notice must contain:

  1. your full name, postal address, email address and telephone number;

  2. identification of the material that was removed or disabled, and the location at which it appeared before removal;

  3. an explanation of why you believe the material was removed in error, or why you have the right to use it, with any supporting evidence;

  4. a statement that the information in the Counter-Notice is accurate and complete; and

  5. your signature, which may be an electronic signature.

8.3 On receiving a Counter-Notice that contains the information listed in clause 8.2, we may send a copy of it, including your name and contact details, to the person who sent the Infringement Notice.

8.4 After a reasonable period, we may restore the material concerned, unless the person who sent the Infringement Notice informs us that they have started proceedings before a competent court or authority in relation to the material, or we otherwise conclude that the material infringes the Intellectual Property Rights of another person or breaches the Terms of Use.

8.5 A Counter-Notice must be made in good faith. Clause 6.5 applies to a Counter-Notice as it applies to an Infringement Notice.

9. Repeat infringers

9.1 Where a person repeatedly submits User Content that infringes the Intellectual Property Rights of others, or is otherwise found to have infringed Intellectual Property Rights through the Platform on more than one occasion, we may, in appropriate circumstances, withdraw that person’s ability to submit User Content, and may suspend or close that person’s Account in accordance with the Terms of Use.

9.2 Before taking action under clause 9.1, we take into account the number and seriousness of the infringements and any Counter-Notice received.

9.3 The suspension or closure of an Account under clause 9.1 does not affect any Order already accepted, or any pending return or refund, each of which is dealt with in accordance with the Terms of Use and the other Policies.
