1. ABOUT THESE TERMS
These Terms & Conditions (“Terms”) govern your use of the ONEBASKET.AE website and the purchase of products through the online store operated by:

For these Terms:
- “NEXTAURA”, “we”, “us” or “our” means NEXTAURA 360 L.L.C-FZ.
- “Website” means onebasket.ae and associated online-store pages operated by NEXTAURA.
- “Customer”, “you” or “your” means the person accessing the Website or purchasing a Product.
- “Product” means a product offered for sale through the Website.
- “Order” means an order submitted by a Customer.
- “Third-Party Provider” means an independent payment processor, courier, logistics provider, manufacturer, distributor, technology provider or other external service provider.
By accessing the Website, creating an account, placing an Order or purchasing a Product, you agree to these Terms.
If you do not agree with these Terms, you should not use the Website or place an Order.
2. WEBSITE AND E-COMMERCE INFORMATION
The official online store operated by NEXTAURA is:
NEXTAURA may use ONEBASKET as its online retail/e-commerce website or storefront brand while the legal contracting entity remains NEXTAURA 360 L.L.C-FZ.
The applicable legal entity, contact information and other required business information will be displayed on the Website and/or applicable invoice.
3. ELIGIBILITY
By placing an Order, you confirm that:
- you have the legal capacity to enter into the transaction;
- all information provided by you is accurate;
- you are legally permitted to purchase the relevant Product;
- you will use the Website lawfully;
- you will not use the Website for fraudulent, abusive or unlawful purposes; and
- you will comply with applicable UAE laws.
Where an Order is placed on behalf of another person or entity, you confirm that you have the authority to do so.
4. PRODUCTS
NEXTAURA may offer various permitted consumer Products through the Website.
Products may include, subject to applicable licensing, approvals and availability:
- mobile phones and consumer electronics;
- household electronics;
- garments and apparel;
- lifestyle products;
- personal-care products;
- wellness-related products;
- accessories;
- household products; and
- other permitted consumer Products.
Some Products may be subject to specific regulatory, safety, warranty, age, storage, usage or other requirements.
Where specific Product conditions apply, those conditions may be displayed on the relevant Product page, checkout page, invoice, warranty document or other applicable documentation.
5. PRODUCT INFORMATION
NEXTAURA makes reasonable efforts to provide accurate Product information.
Product information may include:
- Product name;
- brand;
- model;
- specifications;
- colour;
- size;
- capacity;
- country of origin;
- warranty information;
- availability;
- price;
- applicable warnings;
- usage instructions; and
- return/exchange conditions.
Customers should carefully review Product information before placing an Order.
Minor differences in:
- colour representation;
- packaging;
- labels;
- manufacturer packaging;
- accessories;
- software versions; or
- non-material specifications
may occur where the manufacturer has made a change that does not materially alter the Product.
Nothing in this clause permits misleading or materially inaccurate Product information.
6. PRODUCT AVAILABILITY
All Products are subject to availability.
The display of a Product on the Website does not guarantee that the Product will remain available until an Order is accepted.
NEXTAURA may:
- limit quantities;
- discontinue Products;
- change availability;
- correct inventory errors;
- restrict certain Products to certain locations; or
- remove Products from the Website.
If NEXTAURA cannot fulfil an accepted Order because a Product is unavailable, NEXTAURA will provide the remedy required by applicable law, including an applicable refund where required.
7. PRICES
Product prices are displayed on the Website.
The applicable checkout amount may include:
- Product price;
- VAT, where applicable;
- delivery charges;
- applicable disclosed service charges; and
- other applicable charges disclosed before checkout.
The final payable amount should be displayed before the Customer submits the Order.
Prices may change before an Order is accepted.
Once an Order has been accepted, the applicable transaction price will generally remain applicable, subject to correction of an obvious technical or pricing error where permitted by law.
8. OBVIOUS PRICING OR TECHNICAL ERRORS
NEXTAURA takes reasonable care to ensure that prices and Product information are accurate.
However, technical, typographical, system or pricing errors may occasionally occur.
Where an obvious error is discovered before fulfilment, NEXTAURA may:
- contact the Customer;
- cancel the affected Order; or
- provide the Customer with the option to proceed at the correct price where applicable.
If payment has already been collected for an Order that is cancelled because of such an error, NEXTAURA will process the applicable refund in accordance with UAE law.
9. ORDER INFORMATION
Customers must provide accurate and complete information, including where applicable:
- full name;
- mobile number;
- email address;
- billing information;
- delivery address;
- apartment/villa/building information;
- emirate;
- payment information; and
- other information reasonably required for fulfilment.
The Customer is responsible for reviewing this information before submitting the Order.
NEXTAURA is not responsible for delays or failed deliveries caused by incorrect or incomplete Customer information, except where applicable law provides otherwise.
10. ORDER ACCEPTANCE
Submitting an Order constitutes an offer by the Customer to purchase the relevant Product.
An automated Order acknowledgement may confirm receipt of the Order but does not necessarily constitute final acceptance unless expressly stated.
An Order may be accepted when NEXTAURA:
- confirms the Order;
- confirms payment and proceeds with fulfilment;
- dispatches the Product; or
- otherwise communicates acceptance.
NEXTAURA may refuse or cancel an Order before acceptance for legitimate reasons, including:
- Product unavailability;
- payment failure;
- suspected fraud;
- incorrect pricing;
- technical error;
- regulatory restrictions;
- delivery restrictions;
- inaccurate Customer information;
- suspected misuse;
- unusual or excessive quantities; or
- other legitimate operational reasons.
11. FRAUD, ABUSE AND SUSPICIOUS ORDERS
NEXTAURA may take reasonable measures to prevent fraud and abuse.
Where an Order appears suspicious, NEXTAURA may:
- request verification;
- request confirmation of payment details;
- request additional information;
- delay fulfilment;
- cancel the Order;
- restrict an account; or
- take other lawful measures.
Examples of potentially abusive activity include:
- repeated fraudulent Orders;
- use of unauthorized payment methods;
- repeated chargebacks without legitimate basis;
- false claims of non-delivery;
- false claims of damage or defects;
- manipulation of return/refund procedures;
- repeated misuse of promotional codes;
- attempts to obtain refunds while retaining Products;
- providing materially false information;
- purchasing Products for prohibited purposes; or
- coordinated or systematic abuse of the Website.
Nothing in this section limits a legitimate statutory consumer right.
12. PAYMENT
Payments may be made through the payment methods displayed on the Website.
Payment processing may be performed by independent payment service providers.
NEXTAURA may receive transaction information necessary to confirm and fulfil an Order.
If payment is:
- declined;
- reversed;
- cancelled;
- disputed;
- unauthorized; or
- otherwise unsuccessful,
NEXTAURA may suspend or cancel the relevant Order, subject to applicable law.
13. DELIVERY
NEXTAURA may use independent courier and logistics providers.
Estimated delivery times are estimates unless expressly stated as guaranteed.
Delivery may be affected by:
- traffic;
- weather;
- public holidays;
- courier capacity;
- incorrect address information;
- customer unavailability;
- security restrictions;
- regulatory restrictions;
- technical problems;
- force majeure events; or
- circumstances beyond NEXTAURA’s reasonable control.
NEXTAURA will take reasonable steps to facilitate delivery.
14. FAILED DELIVERY
Where delivery fails because:
- the Customer provided an incorrect address;
- the Customer provided an incorrect telephone number;
- the Customer is unavailable;
- the Customer refuses delivery without a valid reason;
- access to the delivery location is unavailable; or
- the Customer otherwise prevents reasonable delivery,
NEXTAURA may arrange another delivery attempt or return the Product to its fulfilment location.
Any additional charges, where legally permissible, will be disclosed to the Customer before being imposed.
Mandatory consumer rights remain unaffected.
15. RECEIVING AN ORDER
Customers should inspect the external condition of the package upon delivery where reasonably possible.
If a package appears materially damaged, the Customer should record the issue and contact NEXTAURA as soon as reasonably practicable.
Where a Product is claimed to be damaged, defective, incomplete or incorrect, NEXTAURA may request:
- Order number;
- photographs;
- video evidence where reasonably appropriate;
- serial number;
- IMEI number for mobile devices;
- description of the issue;
- packaging information; and
- other reasonable information necessary to investigate the claim.
Such requests are intended to prevent fraud and establish the condition of the Product and do not remove mandatory consumer rights.
16. RETURNS AND REFUNDS — GENERAL RULE
Returns, refunds and cancellations are governed by the separate Returns, Refunds & Cancellation Policy published on onebasket.ae.
The applicable Product page may also identify whether a Product is:
- returnable;
- exchangeable;
- non-returnable;
- non-refundable for change-of-mind purposes; or
- subject to special return conditions.
These conditions will be disclosed before purchase where required.
17. NON-REFUNDABLE PRODUCTS
Certain Products may be designated as “Non-Refundable”, “Non-Returnable” or subject to restricted returns.
Examples may include Products whose nature, packaging, hygiene, safety, consumable characteristics, customization or other lawful characteristics make return or resale inappropriate.
Where a Product is non-refundable or non-returnable for voluntary/change-of-mind purposes, that condition will be clearly stated on the Product page and/or checkout before purchase.
A non-refundable designation does not exclude mandatory legal rights relating to:
- manufacturing defects;
- defective goods;
- damaged goods;
- materially incorrect Products;
- Products materially different from the stated description;
- safety issues; or
- other circumstances where UAE law provides a return, replacement, repair or refund right.
UAE e-commerce law expressly provides consumer return/replacement rights in specified circumstances, while also identifying circumstances in which the right may be forfeited. (UAE Legislation)
18. CHANGE-OF-MIND RETURNS
A change-of-mind return is a voluntary return where the Product is not defective and the Customer simply no longer wants the Product.
Where NEXTAURA offers a voluntary change-of-mind return, the Product must comply with the conditions stated in the applicable Return Policy.
Depending on the Product, these conditions may include:
- return within the stated period;
- Product in acceptable condition;
- required accessories included;
- original packaging where required;
- manuals and documentation included;
- security seals intact where applicable;
- no unauthorized modification;
- no customer-caused damage; and
- Product suitable for resale where the nature of the Product requires this.
NEXTAURA may reject a voluntary return that does not satisfy the applicable return conditions, subject always to mandatory UAE consumer rights.
19. MOBILE PHONES — SPECIAL RETURN POLICY
Mobile phones and similar high-value electronic devices may be subject to special return procedures because of their serial numbers, IMEI numbers, activation status, software configuration, security settings and risk of misuse.
19.1 Change-of-Mind / Voluntary Return
Where a voluntary return is permitted for a mobile phone, NEXTAURA may accept an opened-box return provided that:
- the request is made within the applicable return period;
- the device is not damaged;
- the device has not been subjected to liquid damage;
- the device has not been physically modified;
- the device has not been repaired by an unauthorized person;
- the device is not rooted, jailbroken or otherwise materially modified where such modification affects the return/warranty assessment;
- the device is not blocked, blacklisted or reported lost/stolen;
- all applicable accessories are returned;
- the IMEI/serial number corresponds with the Product supplied;
- the device is returned in an acceptable condition;
- required original packaging is returned where applicable; and
- the device can reasonably be processed under the applicable return conditions.
NEXTAURA may inspect the device before approving the voluntary return.
Opening the box by itself does not automatically create a refund entitlement where the Product is otherwise subject to a lawful non-returnable or restricted-return condition.
20. MOBILE PHONE DEFECTS
If a mobile phone develops a genuine manufacturing or warranty-covered defect, NEXTAURA will assess the device and provide the remedy applicable under the manufacturer’s warranty and UAE law.
Where repair is the appropriate warranty remedy, NEXTAURA may arrange repair of the device rather than treating the matter as a change-of-mind return.
The Customer must not represent a suspected defect as a change-of-mind return or otherwise attempt to bypass the warranty/repair process.
NEXTAURA may inspect the device to determine:
- whether a defect exists;
- whether the defect is covered;
- whether the issue resulted from Customer use;
- whether the device has been modified;
- whether liquid or physical damage exists;
- whether unauthorized repair has occurred; and
- whether the IMEI/serial number corresponds to the supplied device.
Where applicable UAE law provides the Customer with a specific remedy, that legal right will prevail.
21. MOBILE PHONE DAMAGE AND WARRANTY EXCLUSIONS
Subject to mandatory UAE law and the applicable manufacturer’s warranty, warranty coverage may not apply to damage resulting from:
- accidental drops;
- cracked or broken screens caused by impact;
- liquid or moisture damage;
- corrosion;
- misuse;
- abuse;
- unauthorized repairs;
- unauthorized replacement parts;
- tampering;
- modification;
- rooting or jailbreaking where relevant;
- malware or unauthorized software;
- use contrary to manufacturer’s instructions;
- abnormal electrical supply;
- use of incompatible accessories where this caused the damage;
- cosmetic damage that does not affect functionality; or
- other Customer-caused damage.
Any warranty exclusion applicable to a Product will be disclosed in the applicable warranty documentation where required.
22. MOBILE PHONE IMEI / SERIAL NUMBER CONTROL
For mobile phones and other serialized electronics, NEXTAURA may record:
- IMEI;
- serial number;
- model number;
- product code; and
- other identifying information.
A return may be rejected where the returned device does not correspond to the device originally supplied, subject to applicable law.
Customers must not:
- exchange the device with another device;
- alter or remove identifying numbers;
- tamper with serial/IMEI information; or
- return a different device.
Suspected fraudulent substitution may be investigated and may be reported to appropriate authorities where legally required or permitted.
23. DEVICE ACTIVATION AND ACCOUNT LOCKS
For mobile phones and other electronic devices, Customers are responsible for removing their personal:
- Apple ID;
- Google account;
- Samsung account;
- device passcode;
- activation lock;
- Find My Device/Find My iPhone;
- biometric lock; and
- other personal security controls
before returning a device where a return is otherwise permitted.
Failure to remove an account or activation lock may delay processing.
NEXTAURA may return the device to the Customer or require the Customer to complete the required removal process before processing a voluntary return.
This clause does not restrict any mandatory remedy for defective goods.
24. DATA ON RETURNED ELECTRONIC DEVICES
Customers are responsible for backing up and removing personal information from devices before return.
NEXTAURA is not responsible for Customer data left on a returned device where the Customer failed to remove it, except to the extent otherwise required by applicable law.
NEXTAURA may reset returned electronic devices where reasonably necessary to process the return, inspect the Product or prepare the Product for lawful resale.
25. DEFECTIVE GOODS
Where a Product is defective, damaged, incomplete, materially different from the description or otherwise subject to a mandatory legal remedy, NEXTAURA will handle the matter in accordance with applicable UAE law.
Depending on the circumstances and applicable legal requirements, the remedy may include:
- repair;
- replacement;
- return;
- refund; or
- another legally applicable remedy.
NEXTAURA may reasonably inspect and document the Product before determining the appropriate remedy.
26. WARRANTY REPAIRS
Where a Product is covered by a warranty, NEXTAURA will follow the applicable warranty procedure.
For warranty repairs, NEXTAURA may:
- receive and inspect the Product;
- document its condition;
- identify the reported fault;
- determine whether the issue is covered;
- obtain Customer approval where required for chargeable work;
- repair the Product where applicable;
- replace applicable parts;
- provide repair documentation; and
- return the Product to the Customer.
UAE regulations prescribe specific requirements for warranty maintenance and repair, including documenting the Product’s condition and providing information regarding repairs and replaced parts. (UAE Legislation)
27. REPAIR PERIOD
Where a Product is being repaired under warranty, NEXTAURA will provide or communicate an appropriate repair period according to the nature of the repair.
Where applicable UAE law requires an alternative Product or another remedy because of the duration or circumstances of a warranty repair, NEXTAURA will comply with the applicable legal requirement.
UAE regulations contain specific provisions concerning warranty repair periods and alternative goods where repairs exceed prescribed periods, subject to the applicable circumstances. (UAE Legislation)
28. CUSTOMER-CAUSED DEFECTS
Where inspection establishes that the reported problem resulted from Customer use, misuse, accidental damage, liquid damage, unauthorized modification, unauthorized repair or another excluded cause, NEXTAURA may treat the matter as outside the applicable warranty.
If the Customer requests a paid repair, NEXTAURA may provide a repair quotation where repair is technically possible.
No paid repair will be undertaken where Customer approval is required and has not been obtained.
29. REPAIR DOCUMENTATION
Where applicable, repair documentation may identify:
- Product;
- model;
- serial number;
- IMEI;
- reported problem;
- inspection findings;
- repair performed;
- parts replaced;
- applicable charges;
- warranty status; and
- repair warranty information.
30. RETURNS — CONDITION OF PRODUCTS
For voluntary returns, Customers must return Products in the condition required by the applicable Product return policy.
Depending on the Product, NEXTAURA may require:
- original accessories;
- manuals;
- cables;
- chargers;
- packaging;
- protective materials;
- warranty documents;
- promotional items; and
- other components supplied with the Product.
Where a voluntary return is allowed but the Product has missing components or customer-caused damage, NEXTAURA may apply the lawful return conditions disclosed before purchase.
Mandatory statutory remedies remain unaffected.
31. NON-RETURNABLE CATEGORIES
Where legally permissible, certain Products may be excluded from voluntary return because of their nature or packaging, including Products that:
- are consumable;
- have hygiene or health-related considerations;
- cannot reasonably be resold after opening;
- have a short shelf life;
- are personalized or manufactured to Customer specifications;
- are sealed Products where opening prevents lawful resale;
- are software/digital products where applicable;
- are media/products intended for one-time use where applicable; or
- fall within another legally recognized exception.
The specific return condition will be stated on the relevant Product page where applicable.
A non-returnable condition does not exclude legally mandatory remedies for defects or non-conformity.
32. NO RETURN POLICY CANNOT OVERRIDE UAE LAW
Any statement such as:
- “Non-Refundable”,
- “Non-Returnable”,
- “No Exchange”, or
- “All Sales Final”
applies only to the extent legally permissible.
Such wording does not exclude a Customer’s mandatory legal rights relating to defective, damaged, incomplete, unsafe, materially misdescribed or otherwise legally protected Products.
33. REFUND METHOD
Where a refund is approved, NEXTAURA will generally process the refund through the original payment method where technically and legally possible.
Alternative refund arrangements may be used where:
- the original payment method is unavailable;
- the payment provider requires another procedure;
- the Customer agrees to an alternative method; or
- applicable law permits another method.
Refund timing may depend on the payment provider or banking institution.
34. REFUND OF DELIVERY CHARGES
Where a refund is legally required to include delivery charges, NEXTAURA will comply with applicable law.
Where a voluntary return is accepted under a discretionary change-of-mind policy, delivery and return charges may be treated according to the applicable return conditions disclosed to the Customer.
35. CUSTOMER MISUSE OF RETURN POLICY
NEXTAURA may investigate repeated or suspicious return activity.
Examples include:
- repeated claims that Products were defective when inspection shows otherwise;
- repeated claims of non-delivery where delivery evidence exists;
- returning a different serial-numbered Product;
- returning used or damaged Products while claiming they were received in that condition;
- removing accessories and returning incomplete Products;
- returning counterfeit or substituted Products;
- manipulating Product packaging;
- repeated abuse of promotional return privileges; or
- making materially false statements.
Where misuse is reasonably established, NEXTAURA may take lawful measures, including refusing discretionary returns, restricting accounts or reporting suspected fraud where appropriate.
Nothing in this clause restricts a genuine statutory consumer claim.
36. PROMOTIONS AND DISCOUNTS
Promotional offers may have separate conditions.
A promotion may specify:
- validity dates;
- eligible Products;
- minimum purchase;
- maximum discount;
- customer eligibility;
- quantity limitations;
- redemption restrictions; and
- other conditions.
NEXTAURA may correct obvious promotional or technical errors.
37. INTELLECTUAL PROPERTY
All Website content, including where applicable:
- NEXTAURA branding;
- ONEBASKET branding;
- logos;
- photographs;
- graphics;
- text;
- product descriptions;
- layouts;
- videos;
- software; and
- other original content
is owned by or licensed to NEXTAURA or the relevant rights holder.
Unauthorized commercial copying, reproduction, distribution or exploitation is prohibited except where permitted by applicable law.
38. ACCEPTABLE USE
You must not:
- use the Website for unlawful activity;
- commit fraud;
- submit false information;
- interfere with Website security;
- introduce malicious software;
- attempt unauthorized access;
- scrape data unlawfully;
- impersonate another person;
- manipulate transactions;
- abuse promotional systems;
- interfere with another Customer’s account;
- use the Website to distribute harmful content; or
- otherwise misuse the Website.
39. WEBSITE AVAILABILITY
NEXTAURA does not guarantee that the Website will always be:
- continuously available;
- error-free;
- uninterrupted;
- compatible with every device; or
- completely free from cybersecurity risks.
Temporary interruptions may occur because of:
- maintenance;
- upgrades;
- hosting problems;
- telecommunications failures;
- cybersecurity incidents;
- technical errors;
- power failures; or
- circumstances beyond reasonable control.
40. THIRD-PARTY SERVICES
NEXTAURA may use independent third-party providers for:
- payments;
- banking;
- delivery;
- logistics;
- hosting;
- cloud services;
- analytics;
- customer support;
- technology; and
- other business functions.
Third-party providers may operate under their own terms and policies.
NEXTAURA is not responsible for independent third-party acts or omissions except to the extent required by applicable law.
41. LIMITATION OF LIABILITY
To the maximum extent permitted by UAE law, NEXTAURA shall not be responsible for losses arising solely from:
- Customer misuse;
- Customer negligence;
- failure to follow Product instructions;
- incorrect Customer information;
- unauthorized account access caused by Customer failure to protect credentials;
- third-party payment-provider failure;
- independent courier delays or failures;
- telecommunications failures;
- temporary Website interruption; or
- circumstances beyond NEXTAURA’s reasonable control.
Nothing in these Terms excludes or limits:
- mandatory consumer rights;
- statutory remedies;
- liability that cannot legally be excluded;
- obligations concerning defective or unsafe goods; or
- liability arising from fraud or other conduct that cannot legally be excluded.
42. FORCE MAJEURE
NEXTAURA shall not be responsible for delays or failures caused by circumstances beyond its reasonable control, including:
- natural disasters;
- extreme weather;
- fire;
- flood;
- war;
- terrorism;
- civil unrest;
- government action;
- regulatory restrictions;
- customs restrictions;
- transportation disruption;
- telecommunications failure;
- major cybersecurity incidents;
- power failure;
- labour disruption; or
- significant supplier or logistics disruption.
Mandatory consumer remedies remain unaffected.
43. CUSTOMER INDEMNIFICATION
To the extent permitted by UAE law, a Customer may be responsible for losses or reasonable costs arising directly from the Customer’s:
- fraud;
- unlawful use of the Website;
- intentional misuse;
- infringement of third-party rights;
- violation of these Terms; or
- submission of materially false information.
This clause does not require a Customer to indemnify NEXTAURA for NEXTAURA’s own unlawful conduct or for matters where such indemnification is prohibited by law.
44. PRIVACY
Use of the Website is also governed by NEXTAURA’s Privacy Policy.
The Privacy Policy explains how Customer information is collected, processed, stored, protected and shared.
45. ELECTRONIC COMMUNICATIONS
NEXTAURA may communicate electronically with Customers regarding:
- Orders;
- payments;
- invoices;
- delivery;
- returns;
- refunds;
- warranty matters;
- account security;
- customer-service requests; and
- other legally permitted matters.
46. DIGITAL INVOICES
NEXTAURA may issue invoices electronically.
Invoices may include applicable information such as:
- provider information;
- invoice date;
- Product description;
- quantity;
- price;
- VAT information where applicable;
- warranty information;
- delivery information; and
- Product serial/identification information where appropriate.
47. VAT AND OTHER TAXES
Applicable UAE VAT will be charged where required.
Where an international order is offered, the Customer may also be responsible for applicable destination-country taxes, customs duties or import charges.
48. INTERNATIONAL ORDERS
Where international delivery is offered, Customers are responsible for ensuring that Products may legally be imported into the destination jurisdiction.
NEXTAURA does not guarantee that a Product legally sold in the UAE may be imported into another country.
49. COMPLAINTS
Customers may contact NEXTAURA regarding:
- Products;
- Orders;
- payments;
- delivery;
- returns;
- refunds;
- warranty;
- privacy; or
- other Website matters.
NEXTAURA will seek to handle legitimate complaints fairly and within a reasonable period.
50. DISPUTE RESOLUTION
Customers should first contact NEXTAURA to attempt to resolve any dispute or complaint directly.
Where a dispute cannot be resolved, the parties may use any applicable dispute-resolution mechanism available under UAE law.
Nothing in these Terms prevents a Customer from exercising mandatory statutory rights or submitting a complaint to a competent UAE authority.
51. GOVERNING LAW AND JURISDICTION
These Terms are governed by the applicable laws of the United Arab Emirates.
Subject to mandatory consumer rights, disputes shall fall within the jurisdiction of the competent courts of the United Arab Emirates and, where applicable, the competent courts of the relevant Emirate.
Nothing in these Terms is intended to prevent a Customer from exercising any mandatory right available under UAE law.
52. NO WAIVER OF STATUTORY RIGHTS
Nothing in these Terms shall be interpreted as:
- removing mandatory consumer rights;
- excluding mandatory statutory remedies;
- permitting the sale of unsafe or defective goods;
- exempting NEXTAURA from obligations imposed by UAE law; or
- restricting a right that cannot legally be restricted.
If any provision conflicts with a mandatory UAE legal requirement, the mandatory legal requirement shall prevail to the extent of the conflict.
53. SEVERABILITY
If any provision is determined to be invalid or unenforceable, it shall be modified or disregarded only to the extent necessary.
The remaining provisions shall continue to apply to the extent permitted by law.
54. CHANGES TO THESE TERMS
NEXTAURA may update these Terms from time to time.
Updates may reflect:
- changes in Products;
- changes in Website functionality;
- changes in payment or delivery arrangements;
- changes in business operations;
- changes in applicable laws; or
- other legitimate business requirements.
The updated version will be published on onebasket.ae with the revised effective/updated date.
For an Order already accepted, the applicable Terms at the time of the transaction will generally apply, subject to mandatory changes required by law.
55. ENTIRE AGREEMENT
These Terms, together with:
- the applicable Product description;
- Product-specific conditions;
- Privacy Policy;
- Shipping & Delivery Policy;
- Returns, Refunds & Cancellation Policy;
- applicable warranty terms; and
- specific checkout terms
form the applicable contractual framework for the relevant transaction.
Mandatory UAE law prevails where applicable.
56. CUSTOMER ACKNOWLEDGEMENT
By placing an Order on onebasket.ae, the Customer confirms that they have:
- reviewed the Product information;
- reviewed the applicable price;
- reviewed applicable delivery information;
- reviewed the applicable return/refund conditions;
- reviewed any Product-specific non-refundable or restricted-return notice;
- reviewed applicable warranty information;
- provided accurate contact and delivery information;
- reviewed the Privacy Policy;
- agreed to these Terms; and
- understood that mandatory UAE consumer rights remain applicable.
